Regulatory Services/Local Laws

Swan Hill Rural City Council's Regulatory Services team is responsible for the implementation of Council's Regulatory Services policies and functions including local laws, animal control, arbovirus program, vehicle parking, fire prevention and stock control. 

 

Local Laws

Community Local Law No. 2 (2007)

This Local Law applies throughout the Swan Hill Rural City municipal district.

The purpose of this Local Law is to:

a. Provide for the peace, order and good government of the municipal district;

b. Provide a safe and healthy environment, in which the residents of the municipal district enjoy a quality of life that meets the general expectations of the community;

c. Control and regulate emissions to the air in order to improve the amenity, environment and quality of life in the municipal district;

d. Ensure that the public can properly use and enjoy public reserves by regulating activities and behaviour in public reserves;

e. Prohibit, regulate and control the consumption of alcohol in designated areas within the municipal district;

f. Manage, regulate and control the different uses to which streets, roads, footpaths and Council land can be put so as to ensure that there is a proper balance between        private uses and the need to maintain freedom of movement for the public; and

g. Manage, regulate and control the keeping of animals and birds.

Local Law No. 1 - Meeting Procedures

The purpose of this Local Law is to:

a.  Provide for the peace order and good government of the municipal district;

b.  Provide for the administration of Council powers and functions;

c.  Regulate proceedings at Council Meetings, Committee Meetings and other meetings conducted by or on behalf of Council where Council has resolved that the provisions of this  Local Law are to apply;

d.  Regulate proceedings for the election of the Mayor and Chairpersons of various Committees;

e.  Promote and encourage community participation in the system of local government by providing mechanisms with the meeting arrangements, for the Council to ascertain the community's views and expectations;

f.  Regulate the use of the Common Seal; and

g. Prohibit unauthorised use of the Common Seal or any device resembling the Common Seal

Street Trading Permits

Business owners who wish to display signage (ie. A-frame advertising), goods for sale or display outside their premises or conduct an outdoor eating facility must apply for a permit under the provisions of Community Local Law Number 2. Please click on the link below for the 2011-2012 Street Trading Application form.

Litter Enforcement

Litter enforcement is governed by Swan Hill Rural City Council's Authorised Officers.  People found guilty of a litter offence may be issued with an on-the-spot fine.

Mosquito Monitoring Program

Swan Hill Rural City Council have a Mosquito Monitoring Program in place that is implemented from November until late April.  The program monitors water bodies (ie. dams) within a 5 kilometre radius of each town within the Municipality for breeding and potential breeding of mosquitoes.  The outcome of the monitoring program is to prevent the spread of arbovirus (ie. Ross River Fever) throughout the area.

Mosquito awareness programs, with an emphasis on self protection and preventative measures, are run throughout the Municipality.

Parking Control and Disabled Parking Permits

Authorised Officers are responsible for monitoring parking within the Central Business District of Swan Hill and Robinvale. The role of the Authorised Officer is to ensure that all vehicles that park within the patrolled areas follow the directions, regulations and signage of the location. Persons failing to follow these conditions are issued with an infringement notice.

IF YOU WOULD LIKE TO OBJECT AN INFRINGEMENT:

As per the provisions of the Infringements Act 2006, a person who has been served with an Infringement Notice or a person acting on that person's behalf with the first-mentioned person's consent, may apply to the relevant enforcement agency for review of the decision to serve the Infringement Notice if the person believes-

(a)  the decision-

                       (i)  was contrary to law; or

                       (ii) involved a mistake of identity; or

(b)  that special circumstances apply to the person; or

(c)  the conduct for which the infringement notice was served should be excused having regard to any exceptional circumstances relating to the infringement offence.

All objections must be in writing and be received by Swan Hill Rural City Council before the due date shown on the Infringement Notice.  Applicants may submit their objection in letter format or by completing the Application for an Internal Review of an Infringement Notice  - please click on the line below.  Applicants will be notified in writing of the outcome of the objection. 

Section 22(2)(e) of the Infringements Act 2006 prohibits Council from taking further Internal Review action or giving further consideration after the decision has been made.  An application for an Internal Review of an Infringement Notice may only be made once per Infringement Notice.  The decision made by Council is final.  If you do not agree with Council's decision you may elect to have the matter heard in the Magistrates' Court.

Please return the completed form in person to the Municipal Offices at 45 Splatt Street, Swan Hill or at the Robinvale Resource Centre, 68 Herbert Street, Robinvale, or alternatively, post the form to PO Box 1222, Swan Hill  VIC  3585.

The Authorised Officers also handle Disabled Parking Permits.  If you wish to apply for a Disabled Parking Permit please ask your doctor to complete the form below and return it to the Municipal Offices at 45 Splatt Street, Swan Hill or at the Robinvale Resource Centre, 68 Herbert Street, Robinvale.
