New classifications of food businesses
Due to the recent changes to the Food Act all premises (new and existing) are to be classified into one of the four new classes. Please find relevant information on the new classes below:
Class 1 Premises: hospitals, child care centres and aged care services which serve high risk food.
Class 2 Premises: other premises that handle high risk unpackaged food.
Both Class 1 and 2 Premises require the following;
Class 3 Premises: premises that handle unpackaged low risk food or high risk pre-packaged food, and warehouses and distributors.

- The type of premises will determine what minimum records you are required to keep;
Class 4 Premises: This includes premises that only undertake the following;
- sale of shelf stable pre-packaged low risk (confectionery, frozen ice cream, milk)
- sale of packaged alcohol
- sale of uncut fruit and vegetables
- wine tasting
- sale of packaged cakes (excluding cream)
- supply of low risk food at sessional kindergarten
- simply sausage sizzle where sausages are cooked and served immediately (sausages, onion, bread and sauce)
- Class 4 Premises only have to notify by filling in the form below and returning to Council's Public Health Services (45 Splatt Street, Swan Hill);
Food Act Construction Guideline for food premises. This guideline provides new and existing food premises with a summary of their responsibilities under the Victorian Food Act 1984.
Online Food Safety Training
Department of Health have launched an online food safety training program called Do Food Safely. This program is freely available and strongly encouraged for all food handlers, especially for staff members/volunteers of Class 3 and 4 premises.

Private Drinking Water Carters
Private Drinking Water Carters are now required to do the following:
- register with the Council where their water transport vehicle is garaged
- once registered, submit Food Act statements of trade, and
- once registered, keep records about which water corporations you purchase your drinking water from.
Mobile and Temporary Food Business
There is now a state-wide registration and notification scheme for temporary and mobile food premises.
Once you have a registration with your Council, you must then inform all relevant Councils about your trading intentions by completing a Statement of Trade.

Application to Transfer - please return this fully completed form with payment to Public Health Services prior to taking over a food business. If you choose to purchase a business without requesting an inspection report you will be liable for all outstanding orders on that property. Further information and advice should be sought from Council's Environmental Health Officers.
