Request property information

Property information statements provide official information held by Council about a property, including building permits, inspections, compliance records, and any relevant notices or orders. These statements are commonly requested during property transactions to help buyers, sellers, and conveyancers understand the building and regulatory history of a property.

There are three types of statements:

Regulation 51(1)

A Regulation 51 statement provides details of:

  • any Building Permit, Certificate of Final Inspection or Occupancy Permit issued within the preceding 10 years;
  • any statements issued under Regulations 64, 65, 66, 67, 231 or 232 of the Building Regulations; and
  • any current notice, order, certificate or statement issued under the Building Act 1993 or Building Regulations relating to the property.

Regulation 51(2)

A Regulation 52 statement provides details about whether the land is:

  • liable to flooding (Regulation 153 – Special Building Overlay);
  • termite prone (Regulation 150);
  • in an area prone to significant snowfalls (Regulation 152);
  • designated land or works (Regulation 154 – Land Subject to Inundation Overlay); and
  • located in a designated bushfire prone area (Regulation 156).

Regulation 51(3)

A Regulation 53 statement allows an owner, mortgagee, or prescribed building practitioner (under section 137B of the Building Act 1993) to request the relevant council to provide the inspection approval dates for mandatory notification stages relating to building work carried out on the land.

Step 1.Determine which information is required

You can request:

  • Regulation 51(1) - historical details of building permits, notices, orders or certificates in relation to a property.
  • Regulation 51(2) - details on designated areas affecting a property.
  • Regulation 51(3) - inspection approval dates of the mandatory notification stages of building work carried out on a property.

Step 2.Have your details ready

To find the correct certificate details, you will need to provide the street address of the property.

Step 3.Have your documents ready

  • You will need to provide a copy of a Title Search.

Step 4.Have your credit card ready
